Nutcracker: FDA threatens Diamond nuts with seizure, calls nuts “drugs”

How bad is it, you ask? The Federal Bureaucracy is so out of control it is has cited Diamond Foods for selling walnuts with “health claims that are not authorized by the FDA.” The agency has declared the walnuts “drugs” and is threatening the nut company with “seizure” of its assets.

The New American reports,

Seen any walnuts in your medicine cabinet lately? According to the Food and Drug Administration, that is precisely where you should find them. Because Diamond Foods made truthful claims about the health benefits of consuming walnuts that the FDA didn’t approve, it sent the company a letter declaring, “Your walnut products are drugs” — and “new drugs” at that — and, therefore, “they may not legally be marketed … in the United States without an approved new drug application.” The agency even threatened Diamond with “seizure” if it failed to comply.

Diamond’s transgression was to make “financial investments to educate the public and supply them with walnuts,” as William Faloon of Life Extension magazine put it. On its website and packaging, the company stated that the omega-3 fatty acids found in walnuts have been shown to have certain health benefits, including reduced risk of heart disease and some types of cancer. These claims, Faloon notes, are well supported by scientific research: “Life Extension has published 57 articles that describe the health benefits of walnuts”; and “The US National Library of Medicine database contains no fewer than 35 peer-reviewed published papers supporting a claim that ingesting walnuts improves vascular health and may reduce heart attack risk.”

This evidence was apparently not good enough for the FDA, which told Diamond that its walnuts were “misbranded” because the “product bears health claims that are not authorized by the FDA.”

The FDA’s letter continues: “We have determined that your walnut products are promoted for conditions that cause them to be drugs because these products are intended for use in the prevention, mitigation, and treatment of disease.” Furthermore, the products are also “misbranded” because they “are offered for conditions that are not amenable to self-diagnosis and treatment by individuals who are not medical practitioners; therefore, adequate directions for use cannot be written so that a layperson can use these drugs safely for their intended purposes.” Who knew you had to have directions to eat walnuts?

“The FDA’s language,” Faloon writes, “resembles that of an out-of-control police state where tyranny [reigns] over rationality.”

    • Speaking as a federal employee, I can tell you what it is. It's a matter of power hungry bureaucrats looking to throw their weight around. As one of the few "conservatives" in government who actually believes in the Constitution of the United States, I'll tell you now, this is why we need this administration cleaned out of office, and most of Congress along with them. Then we need a solid conservative leadership who will clean house of the leftists running these agencies, who will redirect their efforts to where they belong — advisory to the President and not bullying society through micromanaging by regulations. And in some cases, some organization should be shut down altogether. But this will never happen as long as people continue to vote the way they have for several generations now. The only reprieve we've ever had from this nonesense was a little bit during the Reagan years. That's it. Otherwise we've had RINOs and Democrats running things, allowing would-be dictators running our agencies usurping power the Constitution never authorized the government to have.

      • I would like to add to your comments. About half of the Federal Government Agencies should also be thrown out. Ninety-nine percent of them are completely out of control and not needed. Let me name a few: Energy (tell me one good thing they have done), EPA (stopping fuel independence), Education (they are dumbing down our kids-go to voucher schools), IRS (put in Fair Tax), then there are ones who need complete revamping like the FDA and others.

    • I'll take it a step further. The whole thing is known as "empire building." It is natural for organizations, whether public or private, to want to grow. With business, this leads from little mom and pop shops becoming mid-sized businesses and sometimes leading to them becoming major corporations. Thing about Apple Computers. Went from a 'science project' in Steve Job's basement to a multi-million dollar corporation employing thousands upon thousand of people.

      The same happens with government. An agency starts small with a limited role, but the more time goes by, the more those working for the agency want higher pay, more power, etc. To justify this, they seek to expand their roles. The more responsibilities it has — at least on paper — the higher the positions of leadership within government. Also, the more employees they have, the more justification for a bigger budget, etc., ergo even more power. Eventually, they sometimes become a new "cabinet" level position. VERY important for the big shots, and sometimes helps them launch a political career in elected office.

    • When the private sector grows, that's good, because there's more taxpayers and more tax revenue. But when government grows, it's quite the opposite. It places a bigger burden on the private sector. Government may "create jobs," but it's only at the expense of the private sector through "regulation" on one side, and increasing the "tax burden" on the other. What it really does is buy votes for those politicians who created and/or support that particular agency with ever increasing budgets. The bottom line is, government never "creates" wealth. It only consumes wealth. Government can only provide to one party what it has deprived another party of. It takes from one part of society, and gives it to another part, while taking a "cut."

    • In other words, it's just like a legal firm. Why do you think Congress is so full of lawyers? They both do the same thing. Neither "creates" wealth. They simply use their power to seize wealth from one party and redistribute it to another party, while taking a big cut for themselves. And therein lies the rub. Too many voters act the same way. They continue to vote for corrupt politicians — aka, Charles Rangle, Maxine Waters, Barney Franks, et al — knowing they're corrupt, but willing to accept it as long as they get a free hand out from the goodies they seize from others.

      • A classic example of this is the woman who banned Thalidomide. She was so incompetent she allowed the file to sit on her desk for nearly a year after she had issued an OK. When cases of Phocomelia began to appear she remembered the drug, recovered the file and turned the approval into qa denial. For this she was issued a favorable citation???.Incompetency rewarded!!

  5. Sounds to me that Diamond Foods is a big financial supporter of Republicans. Same reason all those dealerships were closed at GM and Chrysler, every one was a known Republican campaign donator, and not one Democratic supporter in either of the large groups of dealerships for each manufacturer that were closed when the federal government took control of them. That defies the odds and shows specific purpose. Diamond Foods must fit in that same scenario, it donates to the wrong political party.

Are health food stores also being threathened with"seizure" for not submitting a 'new drug application' for every single item's health claims? Many kinds of fish contain omega-3 – but who in their right mind would call fish "drugs"? This seems to be another attempt by the FDA to extort money from a large company – health food outlets not being consolidated into a single Big Corporation making 'obscene profits'.

    The FDA needs to do it's job of making sure that ACTUAL DRUGS are safe, yet they allow BigPharma to make their own 'health claims' about the dangerous chemical concoctions they manufacture. FDA <3 BigPharma = political contributions to the socialist state. Surprise. Surprise.

  12. it is about CONTROL and and even more sinister side of this is they don't want people living truly healthy lives. They want them dependent on the governent and big biz and Pharma.
    Look at several issues: flouride in water – absolutely worthless and even poisoness. Aspartame – another poison that cuses all kinds of problems. Sucralose – destroys gut flora, kills red blood cells. HFCS – number one cause of obesity in America, does NOT digest just like table sugar. I could go on and on with many eamples of how the FDA is fraudulent

  26. I tend to agree with the comment from the government employee, since I am one myself. It boils down to “GREED” of power, that leads to “GREED” of money or visa versa. Unfortunately, that leads to “DISTRUST” and DISGUST” and a lack of faith in who to give our support to. Due to this, no matter how one person may try to embrace the attitude of truly resolving our countries problems, it will never happen. That now brings us to “FEAR”. The fear of being destitute. Destitute from what? That depends on who you are and how you live your life and what your willing to lose if you step forward. The average American are now making decisions on almost a daily basis on what they can live without, just to keep a roof over their heads and food on the table. The government needs to STOP looking for ways to take from the average American and start rebuilding our business base here in our country without any help from other countries. Let us average Americans build, provide, earn, and be in demand of our resources again. Yes, we fully understand why we reach out to help others, but it is time to take care of “our own”. Our counties citizens now are beyond being categorized as multicultural. So in reality you are helping other countries because our doors are open to accept new citizens. STOP the stupidiy and start truly embracing the reality! How? Put yourself in the place and mindset of a hardworking average American and the answers will come quickly!
