VA bill to Nullify NDAA indefinite detention of US citizens

Virginia may be on the verge of saying “NO!” to one of the most blatant abuses of federal power in recent years.

As you know, at the end of last year, Congress passed and Barack Obama signed a defense authorization bill which contained a provision [section 1021] allowing American citizens to be arrested on American soil, detained indefinitely, tried in a military court, and deported to a Third World country for torture.

An American could be detained if he “substantially supported” an individual who engaged in a belligerent act against theU.S. or its allies, whether knowingly or unknowingly.

Thus, if you were to sell a gun to a Timothy McVeigh, unaware of his intentions, you could have all of your constitutional rights summarily taken away by Barack Obama and Attorney General Eric Holder under the terms of this new law.

But now, Virginia Delegate Bob Marshall has introduced legislation to prohibit Virginia law enforcement officials from enforcing this unconstitutional language. That bill is House Bill 1160, which has already passed out of its initial subcommittee.

House Bill 1160 implicitly piggybacks on the U.S. Supreme Court’s decision partially invalidating the Brady Law. That case, the Printz case, held that, under our system of federalism, a state can’t, against its will, be turned into a “go-fer” to enforce a federal law enforcement regulatory scheme.

ACTION: Please call your delegate and ask him to support House Bill 1160.

While not nullification per se as the GOA headline may suggest, the bill if passed would effectively nullify the enforcement of the federal statute by state or local police. Of course, this does not bar federal police, armed bureaucrats, or military members from carrying out the provisions with that state.

This means, the real test of “nullification” would be whether the state or local officials are willing to help resist the enforcement of anything the state decrees is a null and void law within its jurisdiction.

And while this is a state house bill and action is thus called for VA residents primarily, you could still take action in your state by calling your own state reps and requesting they introduce a similar (or even stricter) measure in your state.

  You might want to think about that. Or do you REALLY think that Virgina's "Law Enforcement" will protect you against their FedPig brothers if they choose to come after you? If you're that naive, you might want to do some research on "Brothers in Blue" and "Blue Wall". Most local and state "Law Enforcement" aspire to BE FedPig some day…

    That may be true, but we have Ken Cuccenlli (spelling ?) as our Attorney General and he thus far as fought hard to keep us in line with the Constitution. If you recall, he was one of the first to file for Virginia to opt out of ObamaCare so that we would not fall under the 'mandantory' clause in their umpteen thousand page bill. There may be no where to hide from the thugs that are trying to take over, but at least Virginia isn't going to roll over easy.

I am hoping Virginia will be giving Ron Paul our Delegates. For the most part, our leaders seem to have read the Constitution. And I am hoping other States will follow our lead! The NDAA has got to go along with our illegal President, 40 Czars, a whole lot of Unconstitutional Executive Orders and quite a few Representatives,Senators and other high ranking officials (whether elected or not).

I consider the NDAA 'Battlefield America' scam as much an act of treason as the Brady scams and the Pervert Act (USA PATRIOT act). All should be simply repealed and destroyed. A state refusing to co-operate with federal attempts to legalise Kristallnacht is a good start, but we need to go further and excise the liberal extremists, feudalist extremists, and theocrats from our government and excise their defective laws forever from our nation's books.

Everyone, especially McAmnesty and Levin, need to be voted out! That rino McAmnesty co-sponsored this bill with the dem Levin! This is the great war hero who decided that violating the constitution and taking away your 4th and 14th amendment right is just fine! Throw them all out along with the muslim communist, Hussain! Virignia's bill won't stop this in their state. Federal law prevails and they will be persecuted just like the rest of us! This is a law all for show or re-election!

I swear, the more I hear and see of what is going on the more I think "Jesus MUST be returning soon"! It is SO frustrating to see a government that doesn't trust, respect or serve its' people trying to control them and deprive them of rights! Patriots! Right now we must all work to remove the usurper (lower case used intentionally out of disrespect) from as many state ballots as possible. Just simply flooding each state's secretary of state's office with e-mails notifying them that Obama is not eligible because he is not a ntural-born citizen as per precedent reached by the US Supreme Court in Minor vs. Happersett (1875) is a start. Talk to as many people who will listen. Once the great state of Georgia issues its decision on Obama's contempt of court on January 26th, use that verdict as a reference. I pray for Judge Malihi that he rules with force against the usurper – that will start a brushfire in America's mind: others will be inspired to follow. Fortunately, I live in Tennessee. According to state law, if the people want something to become law and the state legislature will not do it, then the citizens of Tennessee can pass it by public referendum.

The only reason this is in the bill in the first place is, the bill WAS NOT READ by our representatives. Here again we have a rider to a bill that shows NOBODY read this bill before they voted for it. If they did, and still voted for it , they are guilty of treason to the republic.
