“Battlefield” USA: Senate bill turns military on U.S. citizens
“I wouldn’t call it an alternative system,” said an administration official who has helped devise the legal response to the terrorist attacks of Sept. 11, 2001. “But it is different than the criminal procedure system we all know and love. It’s a separate track for people we catch in the war.”
Thus reported the Washington Post already in 2002.
The war on terror has no doubt had unintended consequences on American freedom. But recent talk has escalated the already prevalent fears of a police state, and the story is indeed compelling.
When the best of the liberal leftists and the best of the conspiracy theorists agree, you know it’s at least going to be interesting. Today Alex Jones updated his promotion of the ACLU’s monitoring of Senate Bill 1867, the National Defense Authorization Act. The ACLU reported already last Wednesday,
The Senate will be voting on a bill that will direct American military resources not at an enemy shooting at our military in a war zone, but at American citizens and other civilians far from any battlefield — even people in the United States itself.
Jones updated an earlier post by citing Rep. Justin Amash (R-MI) against language in the bill that should have allayed fears, saying it was “carefully crafted to mislead the public.”
The bill itself specifically says that “The requirement to detain a person in military custody under this section does not extend to citizens of the United States.” This is the very language Amash says is misleading: “Note that it does not preclude U.S. citizens from being detained indefinitely, without charge or trial, it simply makes such detention discretionary.”
After reading the text of the bill, I believe Amash is essentially correct. The two sections of the 680-page bill which have drawn all the attention are 1031 and 1032. Section 1031 gives “authorization” for detention, and 1032 gives the “requirement for military custody.” The special exemption for U.S. citizens is under section 1032, and specifically says it refers to “this section.” This means it does not apply to the previous section in which lies an abuse just as egregious—the “authorization” to detain all “covered persons” in “disposition” which includes,
Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.—Sec. 1031(c)(1)
There is no exemption for U.S. citizens in this section.
This threat to our liberties—while it could be defended as only pertaining explicitly to 9-11 type terrorists, is definitely an expansion of the Federal police and military power into the civilian life of the U.S. It is dangerous, and should be opposed on principle.
Further, the bill was crafted secretly without hearing or debate by a liberal Democrat, Carl Levin, along with John McCain, and purports to be simply a Defense spending bill. Deep in its behemoth 680 pages lies this attack on civil liberties.
Sen. Lindsey Graham bragged it will ”basically say in law for the first time that the homeland is part of the battlefield.” Sen. Kelly Ayotte (R-NH) seconded, “America is part of the battlefield.”
But if America is declared a battle zone, then the rules of war apply in this land. This means de facto that some form of martial law applies. This means, as WaPo said at the beginning of this article, that there’s an alternate system—and perhaps it can apply to any of us.
This has been gong on already since 2001:
For example, under authority it already has or is asserting in court cases, the administration, with approval of the special Foreign Intelligence Surveillance Court, could order a clandestine search of a U.S. citizen’s home and, based on the information gathered, secretly declare the citizen an enemy combatant, to be held indefinitely at a U.S. military base. Courts would have very limited authority to second-guess the detention, to the extent that they were aware of it.
What can be done. The bill already passed the House 322-96, so call your Senators now before they vote and say “Vote No” on S.1867, or at least support the Udall Amendment which is more likely seeing this is a general defense spending bill which will get passed somehow.
But in the long run, these kind of abuses and threats to our liberties will only disappear when we have a Congress which halts the permission to use military action, or a President who stops that permitted action called the War on Terror—and then repeal the PATRIOT Act as well.
Until then, Battlefield USA it will be.
The 'war on terror' will be no more successful than the 'war on drugs'. Scrap everything done since the Twin Tower attack and try again – do it right and infiltrate and destroy the mujadeen. Specify that any further attacks on USA will result in our declaring a war on the Middle East host nations and eradicating them. Quit playing politics and start playing for keeps! And eradicate this totalitarian tool of the Communists and Nazis; the bill needs to not only die but be repudiated (along with the Pervert Act (USA-PATRIOT act)) to the extent that anyone trying again will be shot for treason!

I agree. I've been saying that for years, long before the 9/11 attacks. This entitlement/socialist society we live in today has no concept of, nor do they care about the events of recent history (i.e. WWI/WWII, Korea, Vietnam, etc). And with the current government (pretaining to all three corrupted branches of the gov.), we will likely see our liberties destroyed within our live time.

I'm glad to see our friends at American Vision recognizing the agreement of the likes of ACLU and Alex Jones. While having some stark disagreements, groups like this have this in common: they have kids and grand kids and deep down they know that our government (and more accurately, those whom it truly serves) is preparing to go the way of so much of history and turn on its citizens. Everyone one of us who knows anyone in the upper ranks of government, whether executive (including the military), judicial or legislative, should be begging them to listen to this type of analysis. Our true domestic and foreign enemies need to be revealed, and they are not the everyday citizens who will likely be locked up without due process of law under draconian legislation like this.
Don’t confuse a one issue campaign with seeing the ACLU as non hostile to the US Constitution. The ACLU has ulterior motives that involve subversive socialistic and marxist agendas. The military would impede that agenda so they appear to be ‘with us’ on this issue. That’s like cheering hoorah at having the crocodile eat the stampeding gorilla to save you…just before it eats you. So don’t get too chummy with the likes of the ACLU.

At times, this all gets seriously depressing. In my lifetime, I never expected to be concerned about legislation that our own government would use to turn on us. I know there are Americans who would prefer a more aggressive or authoritarian government, but gee guys! Repealing the Patriot Act will take some doing & in fact, many Republicans will be reluctant, at best. If it happens, there will surely be something to replace it. Lets hope whatever gets passed, is not worse than what we now have or will soon have once this latest revision or update gets passed. I also suspect President Obama would rather rule in such an authoritarian state than in our constitutional republic, since he feels our constitution is so limiting.

The feds have already used the military against American citizens or rather those citizens who were fighting for their independence to form their own Confederacy from 1861 to 1865. Read the book entitled "The South Was Right". There have been those in govt. who have been pushing for a strong central govt. to the point of being a dictatorship since the days of the Federalists during the American Revolution. I am concerned about what else they may HIDE in this bill. If he majority of our elected officials don't know what's in the bill and refuse to believe that these things are happening, how can the general public be expected to grasp the gravity of the situation? Another thing that bothers me is, my Democrat Senator will vote with the "Anointed One" no matter what her constituents want. Too bad she is not up for re-election in 2012.

Given all the capabilities now in our control, meaning the United States, how hard would it be for anyone to do something against the peoples? During the time the Forefathers came up out of Egypt they had to seal their doors of their houses with blood and they took their animals inside with them. Why do you think this was? First let me say some of these peoples lived to 900 years of age each. Do you think they sat back and just twiddled their thumbs during their life span? Take India for instance. There has been a proven nuclear waste which could only have come from prior knowledge and availability of weapons as far as I'm concerned. The reason I must be careful how I word my sentences to you is because of a law they are trying to pass concerning anything you may write on the internet. If I can't prove something to you they will use it against me therefore I shall write in a speculative manner. Getting back to the Forefathers placing blood around their door seals this could only be fore one purpose. To seal their household and animals, as I'm sure they took them inside their houses to protect them as well, against airborne contaminants such as Piroclastics and such. Maybe this should give you a hint towards a possibility of ones intentions. If you are kept out of the parks and such, say as to keep any nefarious deeds from another persons eyes, whose to say this may be a precaution to keep any illicit intentions covered say like approaching our volcanoes? You know they have built a fortress in Nevada and are now requiring 10 to 20% of our present food supplies to be prepared for them only even as they are also now presently stockpiling it as well. Wait let me rephrase that. It appears to me they are doing this. Have to state it this way even though one may know it to be true. Oops, have to rephrase again? It appears they are doing so? And what about all those plastic prepared containers. In my opinion one could place 4 to 5 bodies in each one. And then there is the 2 new specially built gas incinerators as well as all the modificatios of trains and the construction of various facilities across this nation. I have seen some pictures of the construction facilities on you-tube and they all have the surrounding bob-wire caps pointing inwards. It would seem to me, if you are trying to keep people out of these recently prepared facilities, the bob-wire should be facing outwards? I would hope you can and will do something to correct these situations if they are true? I'm to old to do anything anymore as I'm over the hill so to speak.
