“Law of War” amendment confirms extreme “indefinite detention” powers
For those who think the “Battlefield” bill is extreme—and for those who are skeptical that it’s not as bad as I reported—you should see what didn’t make it into the bill. An amendment offered by Jeff Sessions (R-AL) and co-sponsored by James Inhofe (R-OK) would have allowed the military to detain an American citizen indefinitely even if a Federal Court found them not-guilty of any crime.
Thankfully, the extra-extreme measure was defeated, but only after Rand Paul (R-KY) forced a roll-call vote.
For those still skeptical as to the true intentions of the Senators pushing the “indefinite detention” sections of the bill, consider the floor discussion between Session and Lindsey Graham (R-SC) in regard to amendment:
Mr. GRAHAM. . . . As the Senator has indicated, in the law of war, you can be prosecuted for a war crime. You could be taken to a Federal court and prosecuted for an act of terrorism, but if you are acquitted, that is not an event that would require us to release you if the evidence still exists that you are a threat to the country and part of the enemy forces; is that correct?
Mr. SESSIONS. That is correct.
A few moments later, they reiterated,
Mr. GRAHAM. Does the Senator agree with me that his amendment that says you can be acquitted but still be held as an enemy prisoner is consistent with the law today?
Mr. SESSIONS. I certainly believe it is.
Mr. GRAHAM. I thank the Senator for offering this amendment.

The Senators also tried to duck transparency and accountability here. Sessions and company were actually attempting to pass this with a mere voice vote, which means there would be no record of which Senators voted for or against. Paul prevented this cowardly tactic and forced a roll-call vote. After this, the measure was defeated, 59-41.
Now you can check for yourself if your own Senators voted in favor this dreaded amendment for indefinite detention of U.S. citizens despite any Court rulings to the contrary.
This discussion also sheds light on the purposes of the larger bill, which still allows the military to detain American citizens under “law of war” without trial, only without the explicit power to defy Court rulings. But as Linsdey Graham said, the law is already consistent with such military defiance.

I find it odd that Mccain, having been a prisoner of war…supposedly, that he would write such a bill. What's up with that? Does it make any sence? He got to where he was somewhat due to the fact he WAS a prisoner of war! So, he wants everyone to see what it feels like, or what. This guy needs recalled as of 10 yrs. ago! Look around your community and tell me the cockroaches are not taking over your personal liberties as we sit here.

By their own volition they have they violate common laws of morality and denegrate themselves to bipedal animals. Even worse most animals are true to their basic nature while these bipedal non humans are parasitic and mad with power.
This bill is perfectly understandable. The government, especially Liberals, has pushed the people to the point where they are ALMOST ready to push back. That push might take the form of another civil war and that possibility scares Congress to death.
So, instead of correcting the conditions that produced the current situation, ignoring the Constitution and US laws, Congress chooses to maintain its power and prepares for war against the citizens of the United States.
What has happened to these bird brain idiots in Washington. I think they have all lost their cotton-picking minds and have let power go to their heads. This country is in the same position Germany was in when the Hitler and the Nazi's took power. If the American people do not vote these jackasses out of office soon, we will definitely go down the drain fast especially if Obama is re-elected.
Terrible things gonna happen before the next elections
Senators Sessions and Inhofe are definitely not "RINO's", and Congressman Paul is not a "conservative" (except possibly on some economic issues). The Senators are among the soundest and most principled conservatives in Congress (and if there is such a thing as a "moderate" Republican, Sen. Lindsay Graham is certainly it). I'm confident the Senators have honest and legitimate reasons for supporting this bill, though I admit I'm not familiar with it. Do you think they wish to abuse the American people? That would be preposterous! (By the way, the term RINO means "Republican In Name Only", which is to say NOT a Republican.)
I strongly suspect that this article doesn't tell the full story behind this law, and that the facts are being slanted to create a false impression of its true meaning and purpose.
If this law were as unlawful and unconstitutional and this article claims, there would be a gaggle of radical leftist, anti-American lawyers swarming to anyone who was thought to possibly have been harmed by it (there probably will be in any event). It would be before the Federal Courts in no time. Do you think the legislators don't know this? I'm sure this fact has been carefully considered by the authors of the bill, and by the Senators who voted for it. For that reason, among others, I'm very skeptical about the above article.

Upon checking the Senate record of the vote on this bill (as linked in the article), I discovered that Sen. Lindsay Graham voted the same way as Sen. Inhofe and Sen. Sessions (sorry for my earlier remarks, Sen. Graham), as did nearly all conservative Republicans. Nearly all "liberal" (leftist) Democrats voted for it. Rand Paul was one of the few Republicans to vote against it (as did John McCain, Susan Collins, and Olympia Snowe, all "liberals"). The question was whether a civilian court could override the national security interests of the U.S. Even though a person might be found not guilty of a specific crime, the U.S. government nevertheless has the responsibility to protect the safety and freedom of its citizens, as required by the Constitution. If the government has evidence that someone poses a serious threat to the safety of its citizens, it has the duty to do what is necessary to ensure their safety, regardless of any particular court decision in an individual case. Individual cases decided by civilian courts, and the U.S. government's duty to the people are two separate things. A personal case would be limited to only the specific facts and evidence relating to the particular charges in that case, but would not necessarily deal with additional facts that might pose other dangers. The government's duty to protect its citizens is its first and foremost responsibility.
Correction: I stated that nearly all Democrats voted FOR the bill, when in fact I meant to say voted AGAINST IT. Sorry for the confusion.
And so the march towards a fascist totalitarian state is quickening! I voted for Ron Paul in 2008 and will do so again! What a shame so many Americans are still asleep! This country needs an enema!!

You don't have a clue what you write about. The 2001 AUMF is what they were re-affirming. Many of those that voted against did so simply because its already law and doesn't need reaffirmed.
The Constitution since day 1 has given power to detain citizens committing War(not Crime) against the Constitution and the United States of America and her Liberties.
I don't trust anything Jeff Sessions votes for or introduces to be voted on. I don't know why Alabama doesn't wake up and vote that piece of crap out of office.
Ron Paul is the ONLY rational choice for 2012! You may not like his foreign policies but the internal threat of our own government is scarier and more pressing than any other issue right now. Incidentally, Ron Paul never said that Iran should have a nuke. He merely said that he could understand why Iran would want a nuke. They are surrounded by coutnries with nukes that are hostile to them.
